Legal Question in Personal Injury in Massachusetts

I was involved in a car accident where I was hit from behind by a large pick-up truck. My car was totalled and I have negotiated a fair price for the value of my car. I was injured in the accident and I had a couple questions. First should I retain a lawyer now or should I wait until I finish with physical therapy? Second I know that the car insurance is responsible for the first $2,000 and then my health insurance picks up the remainder, do I need to start paying the co-pay for PT immediately?

My main issue I feel is I have the same insurance company as the person that hit me so I do not feel they are being helpful to me as a result. I guess I need a little guidance.

You need a lawyer now. The idea is to get as much as possible as quickly as possible. I'm sure a bunch of people will subsequently answer urging you to contact them. Obviously I cannot say whether you should contact them, or someone else. But you should contact someone. You're a fool to be trolling for and possibly relying on advice on the internet rather than taking the time to hire a real lawyer. It is likely you are well on your way to messing up your own case and making task of the lawyer who you eventually hire a lot more difficult. Good luck.

In order to determine the value of the case, the attorneys must look at a combination of factors, including lost wages, pain and suffering, permanency of the injury, any scarring or disfigurement, loss of consortium, periods of disability, etc. Determining the value of a case is an art rather than a science. The amount of the medical bills incurred will be one important factor in determining the value of the case

Representing yourself and negotiating with an adjuster is usually not a good idea! Because you have no experience and no law degree, you are often not aware of the full value of your case. The insurance adjuster may take advantage of your inexperience. Adjusters typically will offer a lot less money to a person representing themselves than they would to an attorney representing a client.

Furthermore, when you are representing yourself in a personal injury or slip and fall case, the insurance company knows that you do not know how to litigate a lawsuit. Therefore you don't have as much leverage with the adjuster.
