Legal Question in Personal Injury in Massachusetts
Is a lawyer required to sue auto insurance?
An auto accident with 5 people injured...1 driver and 4 passengers. A passenger would like to sue but is told by the auto insurance carrier that she must obtain a lawyer or ''get permission'' from the other lawyers to represent herself..is this true?

It is not required, simply prudent.

The insurance company is merely trying to protect itself.
Whether this person seeks representation depends on the nature of the claim, and the potential recovery/settlement. If it is a minimal amount, and this person thinks the offer is reasonable, this person can probably act on their own.
If the damages are more than minimal, this person should, at least, seek advice to make sure the offer is adequate.
There is no requirement to get permission from anyone else. Permission is relevant only when one attorney represents more than one injured. This is due to a potential conflict of interest.
With all that is being asserted have this person contact me, and I will discuss the options.
