Legal Question in Personal Injury in Massachusetts
My mother passed away recently from cancer. Very shortly after her death I began hearing rumors from family members that my sister told people I tried to kill my mother by messing with her morphin drip (which mother didn't have). Also my step father made reports to the police and insurance company that I stole my mothers credit cards and jewerly. Although the investigation is still going on it has been determined by the insurance and the police that this is not true and in fact my sister and step father are the culprits and are trying to make me the scapegoat. There is a case being built against them that they are in collusion to defraud the insurance company and my mother's estate. These lies about me are documented with the police and the insurance investigator. Can I sue my sister and step father for intentional infliction of emotional distress and defamation?

Yes, I would think you could sue. The filing fee for Superior Court is $275 and two summonses are $5 each and then you would need to have them served by sheriff, this would be about $50 for each. You would need to draft a complaint and execute a summons and place in the hands of a sheriff with appropriate instructions for service and at that point you will have sued your sister and step father for whatever claims you set out in your complaint.
