Operating a MV to endanger
During a snow storm on Christmas eve, was parked in breakdown lane to use cell phone (hazards on, lights on), was struck from behind by another vehicle driven by an off duty state police officer. Am now scheduled to appear in district court charged with endangerment in violation of G.L. c.90, s.24.

In Eastern Massachusetts, some superhighways use the breakdown lane as a travel lane during
specified hours. This is posted on the side of the road but many people don't notice the signs. If you
were parked in a travel lane instead of a breakdown lane, this could constitute driving to endanger.
