Legal Question in Personal Injury in Massachusetts

What is parents liability for a child who allegedly hit another child and suit is brought forth against the child and parent?Mass Law says something about $5000 limit, but is this for just the medical or can a parent be sued for things other than medical? What is their total exposure?

Is the child liable, if so, what is their exposure if they dont have anything?

5000 limit is for vandalism, not for hitting another child, there is no responsibility for a parent just because child committed a tort. Parent has no liability as far as this question goes. There are exceptions but none implicated by facts set out in your question. There are other ways to get medical benefits but you probably want to buy some time from an attorney if you are interested in having someone other than your health insurance pay. Best luck JBS
