In a personal injury case, is legal action taken against the driver of the vehicle or his insurance company? the accident occurred in NY state, a no-fault state.

You typically want to make a demand upon the insurance company of the responsible driver to see if settlement can be reached in advance of trial. Generally, though, insurance companies will not take you seriously until you file suit. You must file suit against the responsible party.
