Legal Question in Personal Injury in Massachusetts

personal injury

I was using a shovel and it snapped without warning causing a severe facial injury. I purchased the shovel last year from a major department store. What are my options?

Re: personal injury

Retain an attorney and discuss only with that attorney in confidence a suit against the store and the manufacturer. Good Luck!

Re: personal injury

Sorry to hear about your injury.

When did it occur? Where where you using it? Where did you buy it and do you retain the receipt (or other documentation of the purchase)? What kind of injury did it cause for you; and have you taken (or do you plan to take) any action towards repairing the injury? What do your doctor's say is your prognosis? Finally, have you had any contact with anyone (other than potential attorneys) concerning this issue?

Feel free to contact me directly for a free initial office consultation, without obligation to you.

Re: personal injury

You should stop screwing around writing questions on the internet and hire a lawyer. There are things that lawyers that do this for a living know that you do not, and if you hire a good lawyer he or she could probably obtain a recovery for you. The circumstances of how this happened and how bad your injury is and how it affects your life are all very important. If you are a movie star a facial scar might reduce your earnings, if you work on an assembly line probably not. In any event, you should save the shovel and any pieces and call a competent lawyer quickly before your ability to prosecute a claim is compromised. To answer your questions directly, the options are to screw around with this claim yourself or hire a professional. Regards, John Stewart.

Re: personal injury

You should contact an attorney as soon as possible to discuss your claim. Based on your question, it looks like you may have actionable claims against the store as well as the manufacturer of the shovel. The issue in this type of case is often whether the product was defectively manufactured or assembled. The manufacturing and inspection processes are usually the central issues. Most manufacturers have quality control departments with in-house standards and procedures. Records are generally kept regarding inspections to ensure the product meets manufacturing guidelines. These should be investigated by an attorney who knows what to look for. It is also important to verify that the defect complained of (i.e., the shovel breaking and hitting you in the face)was actually caused during the manufacturing process and was not the result of some abuse or trauma after the product was sold. I recommend that you keep the shovel and take photographs of your injuries, if you haven't already. Please contact me for a free consultation if I can be of any assistance. Good luck.
