Legal Question in Personal Injury in Massachusetts
Prior to getting married, my wife's ex broke into her house when I was there. He broke my ancle and smacked my head against a radiator numerous times. I was out of work for a week, missed an entire golf season - not to mention sleeping with one eye open for 9 months. In addition, he caused damage to the door he kicked in and stole her cell phone. What action do I have ? He is still in criminal court as his laywer keeps continuing the case. This happened a year ago and I was waiting for the criminal procedures to end before I did anything

It may be a good idea to see how the criminal prosecution of your wife's ex turns out, but you are free to bring a civil complaint against him for damages whenever you like. In fact, most claims are subject to a statute of limitations, and you should speak to a lawyer as soon as possible to make sure that you do not miss your opportunity to sue for damages.

the good part is the statute referred to has a three year limitation as this appears to be an
assault and battery case. Hopefully the criminal case goes forward in short order
