Legal Question in Personal Injury in Massachusetts

Should I sue??

Simply, van runs stop sign and hits my car. I have many injuries, though none extremely serious. He totals the car. I'm out so far two and a half days of work, I'm still in pain and have many bruises. I've made two hospital trips, one to remove glass fragments from my scalp and one to splint my wrist.

The car was only five years old, I don't owe a lot on it, but I'm out a lot of money. What should I do?

I hope your injuries heal quickly. This is going to be a difficult time for you. There are three kinds of insurance overlapping for you here.

Your health insurance. The health and wage-loss coverage through your own car and the other person's liability coverage. They usually go in about that order. The coverage on your vehicle is no-fault but has limits it's called PIP.

This doesn't even take into account the property damage question - which should be pretty straightforward. People are not always happy to learn what the insurer thinks about the value of their vehicle.

The liability case will not be able to be measured until after you know the full extent and duration of your injuries. I hope you are feeling better.
