You have a right to sue for compensatory damage (not punitive damages) if the negligence of another party causes you harm. You need to prove negligence, which might or might not be so easy to prove. You will probably need to preserve evidence and then retain the services of an expert who is knowledgeable about tires and tire installation workmanship. You will also need to prove your claim medically and disability, lost wages and "pain and suffering." You likely do not have a claim for punitive damages, which are available only as provided by statute, but a knowledgeable attorney would have to obtain additional facts from you before making this determination.
