Town liable?

I was involved in an car accident, which is a no fault on my part, and it could have been avoided if I did not hit a patch of sand near the utility pole. Is the town liable for my damages? My brand new car was totaled and I also broke my hand.

Whether the town can be held liable will depend on the circumstances surrounding the patch of sand; whether it created a dangerous driving condition and when the town was put on notice of this condition... in short, whether the municipality was negligent and whether the accident could have otherwise been avoided.
