To threaten someone, whether in public or private, is illegal. The criminal charge is called "threatening."

Any threat to commit an act that would be a crime, is itself a crime. To kill someone is murder or manslaughter. To announce that you intend to kill someone would be used to show premeditation, and thus the strongest form of punnishement, for first degree premeditated murder.

Threatening can be a basis of a civil or criminal complaint. In addition, if it meets certain conditions, you can also seek a restraining order against the person.
