Legal Question in Product Liability in Massachusetts
Non consenting picture of my daughter.
My wife found a picture of my 5 year old daughter on the outside of a box from a car seat manufacturer. We have had her picture taken at the local mall for birthdays,christmas,etc... but have not given anyone consent to distribute her photo. Just wondering where we go from here? Thank You David

Re: Non consenting picture of my daughter.
The use of one's photo for commercial gain without consent is considered a form of invasion of privacy. You are entitled to bring a claim on your daughter's behalf to recoup the value of using her image for advertising purposes. There are time limits for bringing such claims. You should call an attorney for more details. We'd be happy to speak with you.
