1/3 home ownership/deed

Hello.

I have been with my male companion for 25 years. My brother and I owned each half of a house and then my brother sold his half to my companion about 13 years ago. So my companion owns 2/3 of the house and I own a third. The deed is written that way.

I asked my companion if he is willing to buy my third of the house. He refuses. Is there any way a court action can be taken to force him to buy my third? Thank you.

There is a legal action in Massachusetts that addresses this situation. It is called a "Petition for Partition". In short, it forces the sale of the real property and a proportionate division of the net sales proceeds.

An action to partition property will result in an order to sell the home, at which piint, your companion can either buy out your share or allow the entire home to be sold and you would each take your respective shares.
