Legal Question in Real Estate Law in Massachusetts
10 porta potties set abutting my restaurant's lot
This is a fairly new, successful restaurant, and the owner of the lot next door is trying to extort my boss for parking fees. His business isn't even open at the same time as the restaurant. The restaurant's lot is not too large. We are currently not even using his lot. He has his lot completely roped off. I know that's legal, but he has not gotten what he wants so far, so now he has lined the boundary with porta potties. Very Attractive... What can we do? We are very cash poor at the moment. We are on the brink of our busy season on Cape Cod. What ever happened to ''Love Thy Neighbor''

You certainly cannot use his lot without his permission. However, as to the Porta-Potties, I would complain to the town, it is a nuisance of sorts.
I would put up a sign in the restaurant asking patrons not use the neighbors lot.
Please feel free to have your boss call me if he has more questions.

I agree with Roth. As to the porta potties, he may need permission from the town to place these on his property. I would contact the building inspector. But know this, it sound like the beginning of a war. As for love thy neighbor, that expression is certainly not present in business.
