Hello, I have 2 simple questions
1--How do I find out if my home has the homestead act already on it?
2--How do I go about having one done?

Go to the web site for the "Registry of Deeds" for your county. Look for the homested forms and instructions. Follow the simple instructions. If you need help, call the regitrars office and speak with a clerk.

You can check online at the r"egistry of deeds" for the county your home resides. You look up your name or property address. You can download the form from most registry's websites or by going to the MA trial law library online and they have the form. Fill it out and mail it to the Registry of deeds with the filing fee.

Start here http://www.masslandrecords.com/malr/index.htm. You can search by property or by owner's name. If there is a Declaration of Homestead, it will be recorded. If you would like a Declaration of Homestead form prepared and filed, don't hesitate to contact my office.
Research the grantor and grantee records in the registry of deeds for the county in which the property is located, most of which are available on line. Once on that website you will also find forms and instructions for filing a Declaration of Homestead. You may also retain an attorney to do so for a modest flat fee. Good Luck!
