Legal Question in Real Estate Law in Massachusetts
Abutting property foul odors limiting use of my property
I own a 2nd floor condo abutting/attached to another property. The 2 properties have adjoining decks. My deck is open air, the abutting is fully enclosed. Abutting decks are separated by an open doorway covered in trellis. Abutting property is emitting foul odors and appears to have unsanitary waste stored on the deck. The odor is so foul, it is preventing use of my deck and prevents me from opening my windows. Unable to reach tenant and landlord of abutting property. Trying to determine my rights (installing a solid door, what public service agancies can be contacted, etc.).

The First step is to call the local board of health and file a complaint with the Condo Association Management.
The Board of Health should issue a citation and if it continues you can press them to take action

You can call the board of health for the town or city you live in to report unsanitary conditions.
