Legal Question in Real Estate Law in Massachusetts

adding a name to a deed

Me and my dad were wondering how to add my name to his deed. Ive heard of tax issues and dont know if it applied to me or him. Also he is joint owner with my mom who is in a nursing home and not of sound mind. She has been under medicaid also and dont know if that is a problem. Ive put a large amount of money into the house I.E. saving it from foreclosures and major furnace work. Dad just feels we should try to see if theres anything that can be done. Any information would be appreciated. Thank you

Re: adding a name to a deed

Simply adding someone to a deed is not a big deal, although it can have consequences, as you've already found out. From your posting, however, I think you would be best served by sitting down with an estate planning lawyer and sorting through the various issues here, especially if your mom is not of sound mind and may need public financial assistance, e.g., medicare or medicaid. I don't do that type of work, but if you call me I will refer you to a colleague in your area. 617-367-4260 Best wishes.
