Legal Question in Real Estate Law in Massachusetts

amend civil suit

What do I have to do to amend a civil suit to include more damages and a more definitive statement. An attorney prepered the suit, horrible experience, and now I have the task of fixing it.

With all due respect, even if you do not feel that your prior attorney did a good job with the Complaint, you should think twice about going pro se.

Civil litigation is not a simple process, and notwithstanding your dissatisfaction, you should consider seeking new counsel.

Your questions makes little sense. If Jonathan had not accepted it, I would have suggested that you rewrite it.

Re: amend civil suit

It depends on the situation, if the other side has made a Motion for a more definite statement, you can file an Amended and Restated Complaint to include the items requested.

If not and they have filed an answer, you need to file a Motion for leave to Amend your complaint.

If you have more questions, please feel free to call me.
