Legal Question in Real Estate Law in Massachusetts

Apartment rental

I emailed about my niece putting $2900.00 on a apartment signed a year lease and the next day she recieved housing and got her kids back and this apartment was leagaly to small for 3 people it was a one bedroom it was 2 weeks before he could even move in and she never even steped in to the apartment to live only when she looked at it and the man wont give her her money back what to do ?? please help.

You have not stated any reason why the landlord should have known what you know. You have not stated any reason why the landlord should give the money back.
