Legal Question in Real Estate Law in Massachusetts

Since August of '09, my husband and I are have been battling our mortgage company over a loan modification. We absolutely qualify. We always pay our mortgage on time in full but our other bills are late. They fight with us, never contact us and change their "policies" every time we call. They even told us to miss our payments (call was supposedly recorded). If and what type of action can I take against them? Do I need an attorney? Would it be costly, we do not have any money. I'm a stay at home mom to a 2 yr old and my husband works 50 - 60 hours a week to provide for us.

Many of these cases exist. While I would recommend you talk to an attorney about your case, I have a certain bias, because I handle these cases. As far as a fee, you need to talk to each individual attorney about his or her policies. Personally, I can be flexible as to fees, but that flexibility is dependent upon many factors best only discussed in person.

Briefly, it may be desirable to sue the bank you are working with, depending upon where you are in the foreclosure process. If you are to contact me, I will need your property address, and to sit down with you, and review your paperwork.
