Legal Question in Real Estate Law in Massachusetts

We bought our home 11 years ago. Only his name is on the house deed/title and only his name is on the mortgage. Is it possible for me to get my name on the house deed/title without us being married??

Thank you for your question.

The only way to make you an owner of the home is to have the other co-owner prepare and sign a deed granting title to the home from "John" to "John and Sally". You really don't want to do this without an attorney. Technically, you will need to obtain the permission of your mortgage company before doing this, as a transfer like this is likely a violation of the terms of your mortgage, and could jeopardize your loan.

The best option is to refinance the loan and prepare a deed of transfer for recording at that time.
