Legal Question in Real Estate Law in Massachusetts

commissioner fees

I heard that the court determines the commissioners fees but I recieved a bill for his services $60,000. Which is true?

Also doesnt he have to inform me where my house sale money is being held during the equity division and am I entitled to the interest? Thank you

Re: commissioner fees

You have the right to challenge the commissioners fees, if youthink they are unreasonable.

The money, if it is going to be held for any length of time, should be placed in an interest baring account for the benefit of the beneficiaries of the property being distributed. If it is a matter of a couple of days, the money is likely to be placed in an IOLTA account.

If the Commissioner pays the money into the Court, the money will accrue interest in the court's trust account.

Good Luck
