Legal Question in Real Estate Law in Massachusetts
Condo Board of Trustees Secrecy Doctrine
Over the past year my upstairs
neighbors have had 5 dance parties
until 6am in the morning. Three
different owners wrote in
complaints. The procedures for
breach in condo rules and regulations
as i understand them calls for a
warning first, then escalating fines
for future violations. When I asked
the Board of Trustees what, if
anything, has been done, the
Trustees sent me the following email:
''The Manager has once again
passed on your e-mails regarding unit
4A. I need to remind you that the
Trustees have a legal responsibility to
keep confidential, any punitive
actions taken in response to
infractions of condo rules. I assure
you that we take all such complaints
seriously.''
Is there any law or statute that
would support their doctrine of
secrecy? I find it hard to believe that
the trustees have the right to act, or
not act, with impunity, without
informing vested owners.

Re: Condo Board of Trustees Secrecy Doctrine
I have heard of this before, and unless the condo rules permit this "secrecy" I believe it is a routine. I do believe that the complainant should be informed of the outcome of the investigation and the decisions.
You can always ask/demand for the written source from where they acquired this code of silence.
