Legal Question in Real Estate Law in Massachusetts
condo law MA
I'm in a 9 unit codo and the other owners want to put 4 air conditioning units on my roof. I have a skylight and they will be visible from my living room. They may also generate noise. Is there a law that protects a single owner from having her property values decressed because the majority want to put these air conditioners on the roof?

Perhaps you should consider retaining an attorney to review your condo documents and the minutes of all trustee meetings at which the postioning of the A/C units were discussed to determine whether you received sufficient notice to have opposed it and to determine whether it constitues a breach of your quiet enjoyment of your premises or an overburdening of the common areas.

Without reviewing your condo documents, it is difficult to know how to advise you. If this is an improvement not a repair, the approval may require 100% consent.
Likewise, if the placement of the air conditioners are such that they create a nuisance, then there is another issue as well.
I would recommend you contact an attorney in your area as soon as possible. Please feel free to contact me if you have any other questions.
