Legal Question in Real Estate Law in Massachusetts

Can a Condo owner sue the Board of Trustees and/or Property Management Company for not making the necessary repairs to the property of a Condo Owner?

Ex: Bricks on the front brick stairs are completely off the step of my Condo Unit and this is property that is covered in accordance with the By-Laws of the Condo Documents.

If that is common area, the trustees should be repairing it immediately. Rather than suing, you may want to consider other options, such as engaging counsel or even threatening or demanding arbitration (which may be required by the condo docs). Another option is to demand a meeting of the unit owners or trustees, a right which may also be available to you under the condo documents.
