Legal Question in Real Estate Law in Massachusetts

Condo Trustee Terms

If a Trustee is appointed by the Board of Trustees to fill a vacant seat, and the seat they fill had a two year term. Wouldn't that trustee have to be voted to the board at the next owners meeting by the unit owners? I was told by the management company that a trustee can stay on the board as long as they want.

Re: Condo Trustee Terms

In order to answer this question you need to review the Master Deed and Trust. These documents should clearly detail how trustees are elected (or appointed), the length of the term, who is eligible to be a trustee (in some condos, only unit owners can be trustees), and the powers of the trustees. The Board should be following the procedures outlined in the condo documents. Normally, trustees must be voted on for each term.
