Legal Question in Real Estate Law in Massachusetts
Cutting of Trees
I have a tree that was hit by lightning and the branch was touching the wires for the neighbors phone/electricity. They notified me on Saturday at about 6 pm and I informed them I would look into the removal on Monday. I returned home and they had already had the electric company come down and remove the branch. The branchs were all piled on my lawn because the elec co. will not remove them. They feel it is my responsibility to dispose of the cut branches, etc. As they choose to do this on their own, is it my responsibility or should they be responsibile for the removal of the debris.

Re: Cutting of Trees
You are responsible for the costs of maintaining your tree and ensuring that it does not interfere with public utilities. The costs of removal will be less than if you called someone to cut the tree and then remove it.
