Legal Question in Real Estate Law in Massachusetts
My daughter and her husband are getting a divorce. I loaned them money for a down payment on a house. I found out the house is in his name and he is selling it. What can I do to recover the money ??

Assuming that he does not agree that they owe you the money, you can sue him to establish the debt for money loaned and attach his house. If he agrees that the money is owed, there are other methods than can be employed. In either case, you should consult an attorney.

Assuming you have proof of the loan, you can sue him for the money. I would start by making a formal written demand for repayment at the closing. I would consult an attorney as soon as possible.
