Legal Question in Real Estate Law in Massachusetts

I'm trying to get a deposit back in the amount of 1100.00 from a landlord that decided not to rent to me. The Lease was suppose to start 4/1/11, I gave her the deposit on 3/18/11 in cash (I have the receipt) it was also noted on the lease which was not signed. On 3/31/11 I got arrested on Federal Charges and was unable to sign the lease, with the current events she backed out, understable, however I wouldl like my deposit return. I was unable to find any provisions in the Ma Real Estate Law regarding this matter. In additon because she backed out I was unable to be released on pretrial for an additonal week because I had no address. Thank you for your assistance

You are entitled to you deposit back. If the landlord refuses then you are able to demand it pursuant to a 93a demand and then the landlord might be liable for triple damages and attorneys fees.
