Legal Question in Real Estate Law in Massachusetts

Disclosure

We bought a house on 1/29/99. On two seperate occasions we asked the listing broker what was behind the house. Dense evergreens block view of more than 50 feet.

We moved in and on 3/01/99 it turns out there is a quarry with a permit to blast back there. They have been in business minimum of 8 years.

Questions:

1. Each time we asked, the broker only described what was directly abutting the property the quarry is the next property beyond. Should the broker have told us when we asked? He claimed to be knowledgable about the area he knew we were not.

2. Is there anything in common law that says the broker should have told us about the quarry with the blasting permit?

3. Is there anything in real estate law that says the broker should have told us about the quarry and its blasting?

It seems like the broker broke the law. You should

hire a lawyer; it might be something that one would

take on a contingency basis, but I don't know yet.
