Legal Question in Real Estate Law in Massachusetts

donation of real estate to non-profit organization

A founder is ready to donate residential facilities to a non-profit. The facilities are old but comply with all buildings and fire codes. There is no handicap access to buildings and bath rooms. Will the non-profit have to make the buildings handicap accessible now that the ownership of the buildings has changed? It's not that he non-profit doesn't care about handicapped people it's that the organization is struggling financially and can't afford to make the modifications.

Probably, depending on the use to which the facilities will be put. Contact me if you wish to further discuss.

Re: donation of real estate to non-profit organization

You do not indicate the type of residential facilities and what use for which you intend to use the property.

Dependiing upon the intended use of the property it may or may not require that it be handicap accessible.

Please free to contact me without obligation. I currently represent several non-profits.
