Legal Question in Real Estate Law in Massachusetts

Easement Owner's Obligations

My property includes a 10 foot easement for 4 neighbors ''for foot travel and bathing'' (the easement goes from the street to the water).

Does that preclude me from using the easement myself for other purposes (e.g. a small boat, 6 ft wide, on a trailer)? Am I obligated to keep the entire 10 ft clear? What can I do and not do?

Also, I have placed one small section of easy to walk around fence across the center of the street entrance to prevent anyone from attempting to drive/park vehicles in the easement; the previous owner had 4 large boulders for 30 years which I replaced with the fence.

Can you help?

Re: Easement Owner's Obligations

I am not sure I understand. Are you asking if you can place a boat on the easement or move the boat on the easement to and from the water?
