Legal Question in Real Estate Law in Massachusetts

eastment access

I own a utility easement in the country that my neighbors enjoy walking on. How can I protect my interests in case of any legal issues that may arise with me allowing access?

Re: eastment access

People who use your property may acquire a right of "adverse possession" after many years of use, but only if the use is against your interest and without your permission.

The trick is to let them know they have your permission. Then you save your rights. Write them a letter saying, "I am aware that you are walking on my property at this location...... I want you to you know that at this time, and until further notice, you have my permission."
