Legal Question in Real Estate Law in Massachusetts

Evicting tenant for a family member

Is it possible for me to evict a tenant on a lease that is behind 1 1/2 months rent, for the purpose of supplying my son with a place to live?

Re: Evicting tenant for a family member

You can evict a tenant under a lease who has failed to pay rent by giving the proper notice terminating the lease and then filing a summary process action in District Court or in Housing Court (if there is a Housing Court covering the place where the rental proeprty is located.) However, it is necessary to comply strictly with the requirements of the law. The fact that you wish to give your son a place to live is not relevant to the question of whether or not you can evict your tenant.
