Legal Question in Real Estate Law in Massachusetts

I am the executor of my father's estate. For 13 months since his death i have been making the payments on the loan for the car. To my surprise, the car was repossessed today. I am not behind on the payments. Is there anything I can do to get the car back?

Yes, file suit for return of the vehicle.

I assume no notice was sent to you for the reason it was being repossessed. Contact the lender and find out why and then contact an attorney to assist you with recovering the car and/or the money you paid.

That sounds strange to me.

Have you been appointed executor by the probate court? I assume that you have, but some people assume that the will alone or a power of attorney gives them the power to act on behalf of the estate. Was the car leased or was it purchased? Was the car insured, and if so, by whom?

If you have not yet probated the estate, please contact our office for assistance.
