Legal Question in Real Estate Law in Massachusetts
HOA board abusing power
As a homeowner who has been fined over a year for what the HOA says is an incorrect storm door, do I have the right to challege their placement of a lien on my property when they have refused to answer pertinent questions or produce sufficient evidence.
Also, the President of the HOA and the representative from the management company were approached for the correct info prior to purchase. Not only was it never received but they are the ones sitting in judgment of me.
I feel it is blatant discrimination and harrassment.
What should have been kept in executive session was spread throughout the community by the Board.
I'm in a 55 and over community and on limited income. How do I find the right kind of attorney to represent me?
This has gone on for a year and I'm at my wits end.
In addition to the lien they have charged me ongoing fines and a bill for their attorney's fee.

You have a right to seek legal advice regarding this matter. Perhaps you should do so immediately. Your best defense will probably be provided by a CAREFUL reading of the CCR's and HOA agreement, and a creative negotiating approach by a wise legal counsellor.
