Legal Question in Real Estate Law in Massachusetts

a joint deed,tenants in entirety

I have been threatened by the other owner that they will force me out of my home. All taxes, insurances and utilities are always paid in full and on time. I have made extensive capital improvements to my dwelling ,they have not. They promise to help with failing roofs, doors etc. but do not and I pay all the time myself. They do not help with sweat equity either. They do pitch in for snow removal and grass cutting. Can they force me out?

Your question does not include a detailed description of the form of ownership

or whether you have a lease or rental agreement under which you occupy the house.

However, the other owners can probably bring an equitable action called a petition to partition that

could force the sale of the property, and lead to your eviction. It would be a lenghty and costly

proceeding, but any one other than a married couple has that right.

Re: a joint deed, tenants in entirety

"Tenants by the entirety" is a phrase for a special type of joint ownership of property in Massachusetts owned by a married couple. Perhaps you are mistaken about your title. Why don't you send me your names and address and I'll check the records for you. E-mail to [email protected].

Form of ownership affects your rights.

On what grounds does the other owner expect to be able to force you to move out? Have you been abusive physically (or presenting a real threat of physical harm) to someone there? Are you not paying "rent" to a non-resident co-owner? You haven't made yourself clear to me, I'm afraid, and I can't comment usefully without more facts, I'm sorry.
