If I am Joint owner of property, can I sell my interest in property without consent of other owner.

Thank you for your question.

If you are the joint owner of a property, you are stuck. You are not able to sell the property without the consent and participation of your co-owner. If your co-owner will not budge, there are still things that can be done. You can sell your share of the property to your co-owner. You can purchase your co-owner's share. If your co-owner will not work with you, you can file a special lawsuit called a "partition" and ask the court to force the sale of the property. Our office handles these matters routinely for folks all over Massachusetts and they are usually resolved without a trial when the other co-owner realizes that cooperation is the better option.
