Legal Question in Real Estate Law in Massachusetts

Judgement

My mother and her sister owned a package store together, to which my aunt had all control. A judge ordered my aunt to pay my mother a sum of money and gave her 30 days. She has not complied with the judgement and is now in process of getting a loan. Is this acceptable, and is there any other action that can be taken to collect the money?

Re: Judgement

I think the answer to this should be practical. If your aunt is getting the loan in order to pay the judgment, what's the problem? On the other hand, if she gets the loan and doesn't pay the judgment, then your mother should be upset, particularly if your aunt gave any form of collateral for the loan. There is a procedure called "supplemental process" by which you can enforce payment of a judgment. You should get a lawyer to help you with it, though, as the procedures can be confusing. Good luck!
