lease deposit refund

A contractor of ours was going to work for us in CA. He mailed a bank check to the landlord for an apartment. The position fell through and he will not be needing the apartment. He contacted the landlord 2 days after he sent the check and said he would be not be needing the apartment. Is he entitled to a refund of his initial deposit? Obviously he never took occupancy.
