Legal Question in Real Estate Law in Massachusetts

leaving real property to a disabled relative

I have a 2-family home. Relatives live in one of the apartments; I live in the other. One is disabled and receiving Social Security Disability.

What happens to his only income if I add his name to the deed or otherwise convey all or part of the property to the disabled relative?

Re: leaving real property to a disabled relative

The problem is not so much the effect on his income, it will be the impact on medicaid if the realitive ever needs to seek it for care. This could adversely effect you as well if he/she needs mediccaid before you die or sell the property.

I suggest you meet with an attorney to achieve your goals. If it is that the realitive get the property upon your death, you have a variety of altenatives.

Please feel free to call me if you have more questions.
