Legal Question in Real Estate Law in Massachusetts

liability after sale of home

I sold my home without a realtor all of the legal things were done purchase & sales, inspections, closings etc. The people I sold the house to contacted me 1 month after purchasing my home and informed me that they had water after a severe storm last week. What if any is my liability? Our house was inspected and we never had any water issues or damage prior to selling our home. The house is 14yrs old.

Re: liability after sale of home

Generally, unless you made material representations that the buyer relied upon, you would not have any liability after the closing. Typically, the buyer takes the house "as is" and since the buyer had the home inspected they typically would not have any right to sue the seller for "post" closing problems. If you made material representations which you knew to be false then the buyer may have a claim for fraud. Based on these facts, it does not appear that you made any false representations so you should not incur any liability.
