We have used and maintained a small parcel of my neighbors property that gives us access to our back yard now for 40 years he does not or has not ever used this parcel. He now wants to put up a fence and
Gate. Do we have any legal claim under the adverse posession law?

Adverse possession is the open and notoriuos use of a property without the consent of the owner for a continuous period of 20 years. You can file a lawssuit for Adverse Possession, provided that you meet the requirements stated above and the property is not Registered Lansd in the Land Court District of the County. You cannot adversely possess Registered Land.
