Legal Question in Real Estate Law in Massachusetts

Marina in RI is changing a contract ahoc

I have been at a marina in RI for five years. The contract is for May 1 to Oct. 30. This year I am going in on July 1, 2009 BUT here is my question...they are making me start on July 6th so they can try to rent out my slip on the holiday? Are they making the rules as they go? I emailed the manager and he forwarded my request to his office manager and in his message it said it's up to you... She wrote back and said NO. Can they make it up as they go? They are acting like they are giving me a deal by calling the cost savings of going in on July 1 and not May 1 as a prorated cost savings... I would like to know that I have a right to demand they allowing me to get in on July 1st and not July 6th. Thanks in advance.. Gale

Re: Marina in RI is changing a contract ahoc

First this is a matter of RI law not MA. However, if you signed an agreement to rent the slip for a period of May 1, 2009 thru October 30, 2009 and have been paying the slip charges as billed, they do not have the right to rent out your slip for the Holiday weekend, unless there is a clause that could allow them to do so. Without reading the agreement, I cannot make a definitive decision.

Absent some condition in the agreement, it does not matter when you want to use your slip, they have no right to rent it out.

I hope this was helpful. Please feel free to contact me if you have more questions or if you like I can refer you to a RI attorney.
