A spouse by statute is entitled to the first $200,000 of an estate and depending on the number of children one-half or one-third of your estate.
If you want your spouse to inherit your home, have a Will drawn. If you want the home to go to someone else, then consult an attorney on your best ways to accomplish this before the marriage takes place.

I agree entirely with Attorney Roth. Why rely on statutory presumptions, when you can make a will distributing your estate exactly as you wish?
