Legal Question in Real Estate Law in Massachusetts

Mortgage Fraud, Libel

My current mortgage company, which I filed a complaint with the MA DOB, is unlicensed ( the DOB fined them 31k) they did 66 loans in this state in a 12mo period. They retained counsel in MA, and told them that I was in foreclosure and had to close with them. I WAS NOT!!! Their counsel then told my lawyer. Is that libel? or defamation of character, or slander? We are shooting for a rescission of the mtg, as well as a monetary settlement. What do you think??

Re: Mortgage Fraud, Libel

From what I can tell it sounds like a unfair business claim under Chapter 93a. I would say that, if I read your facts correctly and they can be proved, then you have a very good case.
