Legal Question in Real Estate Law in Massachusetts
Mortgage Lien
I recently bought a condo. I have not recieved any utility bills (electric, gas, water) for the four and a half months I've been occupying the property. Obviously they are being payed because they have not been shut off yet. If I continue to recieve these ''free'' utilities, is there lawfully anything the condo association/prior owner (whoever is paying them) can do to retrieve this money from me? I assume it will eventually catch up to me, but can they ask for thier money back if it's already in the utility companies hands? i.e. put a lien on the mortgage? ruin credit?

Re: Mortgage Lien
Yes. You are ultimately liable. Retain an attorney to review the condominium agreement to see what they say about the liability to pay utility bills. Good Luck!
Re: Mortgage Lien
Yes. Whoever is currently paying Your bills ahs a legal right to recover the money from you, plus costs. the burden was on you, at the time of the closing, to switch the utilities over to your name.
