Legal Question in Real Estate Law in Massachusetts
can you get a mortgage while your property is in litigation
We are in litigation over a property line dispute, it is 6 months into it. Can you obtain any type of mortgage in Massachusetts while the litigation is ongoing in the courts?

Hi & Thanks for Writing -
It's possible, but difficult - you will probably encounter a document at your closing wherein you will be required to affirm that there are no known title problems. A boundary dispute certainly qualifies.
Are you represented by an attorney in the boundary dispute litigation? If so run it by your attorneys. If you're litigating the boundary dispute "on your own," feel free to give our firm a call and I'll take a look at it with you.
