Legal Question in Real Estate Law in Massachusetts

Multi-million property jointly owned with ex-husband; any legal recourse ?

Divorced in 1988; kept multi-million 6 acre shorefront jointly-owned property to leave to our children; now I need funds and want ideally to sell my half; if not, want to ensure it passes to my current husband. Ex-husband refuses to buy me out. Any legal recourse?

You can file a Petition to Partition to force a sale of the property.

You will need an attorney to assist you with this. Please feel free to contact me if you have additional questions.

The information you supplied is incomplete. To best understand the situation, the first step is to review the judgment or separation agreement. Then you need to decide if your present situation is such that if you need to, you can seek a modification of the initial judgment or agreement. If you want to discuss this, please contact me.

Yes. You can proceed with an action for partition to force the sale of the property, either to your ex-husband or any third party at fair market value. We can assist you with proper estate planning to ensure that property or proceeds pass as per your wishes with a minimun of tax consequences.

Please feel free to contact my office if you wish to discuss further.
